California Companies

California’s Supreme Court recently made a ruling that affects many retail and service workers: "all working employees shall be provided with suitable seats when the nature of the work reasonably permits the use of seats". 1

The court explains that, when considering suitable seating:

  • The "nature of work" defining whether a seat is warranted is task specific; if any task reasonably permits a seat, a seat is to be provided (Example: If an employee can do part of his or her job using a seat, and the seat doesn’t get in the way, then he or she is entitled to one).
  • The physical layout of a space and an employer’s business judgment cannot solely determine whether the seat is necessary (Example: An employer can’t cite business knowledge to say that an employee’s job is better performed without a seat).
  • The burden is on the employer to prove that no suitable seat is available, and that's where the Active Collection comes in.

Many of California's Wage Orders contain the following language released by the California Industrial Welfare Commission:

14: Seats
(A) All working employees shall be provided with suitable seats when the nature of the work reasonably permits the use of seats.

(B) When employees are not engaged in the active duties of their employment and the nature of the work requires standing, an adequate number of suitable seats shall be placed within reasonable proximity to the work area and employees shall be permitted to use such seats when it does not interfere with the performance of their duties.2
