your morale | your body | your focus

27 million people in the US work in retail or service.

Most of these jobs require hours of standing, because employers know that an upright posture is friendly and engaging. But standing all day hurts.

California’s Supreme Court recently ruled:

"All working employees shall be provided with suitable seats when the nature of the work reasonably permits the use of seats."2

The “nature of work” allowing a seat is task specific; if an employee can do part of his or her job using a seat, and the seat doesn’t get in the way, then he or she is entitled to one.

The physical layout of a space and an employer’s business judgment cannot solely determine whether the seat is necessary (i.e. An employer can’t cite business knowledge to say that an employee’s job is better performed without a seat). The burden is on the employer to prove that no suitable seat is available.
